Acceptable Use Policy

This Acceptable Use Policy (“Policy”) sets out the rules for using the Devon Artist Network website (“Site”), membership platform, and any related services provided by the Organisation (“Services”) including, but not limited to, Devon Open Studios. By accessing or using the Site or Services, you agree to comply with this Policy.

1. Purpose

The purpose of this Policy is to ensure the Site or Services are used in a lawful, respectful, and inclusive manner that promotes creativity and supports the Organisation’s mission.

2. Prohibited Activities

You must not use the Site or Services to:

  1. Engage in Illegal Activities
  • Violate applicable laws, regulations, or industry standards.
  • Communications fraud, impersonate others, or misrepresent your identity.

B) Distribute Harmful or Offensive Content

  • Upload, share, or distribute and content that is:
  • Defamatory, abusive, harassing, or threatening.
  • Pornographic, obscene, or otherwise inappropriate.
  • Discriminatory or promotes hate speech against any individual or group based on race, ethnicity, religion, gender, sexual orientation, or disability.

  • Misappropriate the intellectual property of the Organisation, other members, or third parties.

D) Interfere with the Services

  • Introduce viruses, malware, or any other harmful code.
  • Attempt to hack, disrupt, or compromise the security of the Site or Services.
  • Use automated systems, (e.g., bots) to scrape, harvest, or manipulate data.

E) Misuse Membership Features

  • Spam or spread unsolicited messages to other members.
  • Exploit community forums, messaging tools, or other features for purposes unrelated to the Organisation’s mission.
  • Share, sell, or transfer your membership account without prior approval.

3. Website

  • Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair, or for reasons beyond our control.
  • We reserve the right to, without notice, withdraw the availability of this website or any of its content and/or any of its functions, information or services.
  • We cannot guarantee uninterrupted and/or reliable access to this website and we make no guarantees whatsoever as to its operation, functionality or otherwise.
  • You are allowed to view, download and print out content from this website for personal use only in accordance with these Terms. All other copying whether electronic, hard copy or other format is prohibited and all other rights are reserved.

4. Member Conduct

As a member, you are expected to:

  • Respect other members, their artwork, and their privacy as outlined in the DAN Code of Conduct.
  • Ensure all content you post is your original work or shared with appropriate permissions.
  • Follow the rules and guidelines outlines in the Terms and Conditions and Articles of Association.

5. Use of Site and Services

  • If you provide your e-mail address in order to submit an enquiry, comment or request for further information, we may contact you regarding your enquiry, comment or request. We may also send e-mails to you about the services that we offer.
  • From time to time we may provide your information to our marketing or IT departments for research and analysis purposes so that we can monitor and improve the services we provide. We may occasionally contact you by post, email or telephone to ask you for your feedback and comments on our services.

6. Monitoring and Enforcement

6.1. The Organisation reserves the right to monitor activity on the Site and Services to ensure compliance with this Policy.

6.2. If you violate this Policy, the Organisation may take appropriate action, including:

  • Removing or restricting access to prohibited content.
  • Issuing warning or suspending your account.
  • Permanently termination your membership without refund.
  • Reporting illegal activities to law enforcement.

8. Changes to this Policy

  • The Organisation may update this Policy from time to time to reflect changes in the law, the Site, or the Services. Any updates will be communicated via the Site or email. Continued use of the Services after updates indicates acceptance of the revises Policy.
  • The failure by us to insist on any occasion upon performance of these Terms shall not thereby act as a waiver of such a breach or an acceptance of any variation of these Terms.
  • A person who is not a party to these Terms may not enforce any of its terms or conditions under the Contracts (Rights of Third Parties) Act 1999.
  • These Terms shall be governed by, construed and enforced in all respects in accordance with the Laws of England.
